用工单位可将被派遣劳动者退回单位的情况

劳务派遣是指劳务派遣单位与被派遣劳动者订立劳动合同后,将该劳动者派遣到用工单位从事劳动的一种特殊的用工形式。用工单位可以将被派遣劳动者退回劳务派遣单位的情况是怎样的?

(一)用工单位有劳动合同法第四十条第三项、第四十一条规定情形的;
