劳务外包与劳务派遣的相互关系有哪些?

劳务外包与劳务派遣作为两种被广泛采用的用工形式,一方面为企业用工带来了便利,另一方面由于涉及用工单位、派遣单位(外包单位)及劳动者三方主体,其法律关系比较复杂,实践中容易产生混淆。劳动者在履职过程中一旦发生侵权纠纷,责任主体的司法认定就会成为该类案件的难点问题。

1、适用的法律不同劳务派遣适用劳动合同法,劳务外包适用合同法。

2、劳务承包单位可以是个人,也可以是法人或其他实体劳务派遣单位一定是严格按照劳动合同法规定的依照公司法的有关规定设立、注册资本不得少于五十万元的法人实体;劳动者完成的工作都是企业的业务或职能活动。
